1. SITE CONTENTS, OWNERSHIP AND USE RESTRICTIONS

The material on this site is protected by copyright under the laws of Australia and other countries through international treaties. Unless otherwise indicated and except for information directly from or links to third-party websites, all rights (including copyright) in all content, other material and compilations contained in, or used to create or support this site including text, graphics, logos, button icons, video images, audio clips and navigational and other software (collectively referred to as the Contents) are owned or controlled and are reserved by Memento Memory Makers and its related companies, affiliates, licensors and licensees. 

We may use graphical images of your final products created using different production technologies to showcase our capabilities.

We may use images which belong to the third parties Memento Memory Makers does not own the right for those products or the images, these images are only to represent the capabilities of our services.

2. PROHIBITED CONDUCT

You are not authorised, without the prior written permission of Memento Memory Makers and any other owner of rights in content that you access via the site, to reproduce, frame, download, store (in any medium), communicate, show or play in public, adapt, change, or create a derivative work from that content.

No trademark (whether registered or otherwise) that is contained on this site or otherwise used by Memento Memory Makers may be used without our prior, specific, written permission or that of the trademark owner.

3. ACCURACY, COMPLETENESS, RELIABILITY AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current however we will ensure that it is accurate, complete and current to the best of our abilities and knowledge. 

The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. 

Any reliance on the material on this site is at your own risk.  This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. 

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. 

You agree that it is your responsibility to monitor changes to our site. We do not warrant that the quality of any products, services, information or other material purchased or outlined by you will meet your expectations, or that any errors in the service will be corrected.

Manufacturing or Engineering tolerance is the permissible limit or limits of variation in a physical dimension, a measured value or physical property of a material based on specific manufacturing process. 

Your rejection of the item based on tolerances, accuracy and physical properties are not acceptable if the final products are within the tolerances of specific material or manufacturing process like 3D printing.

The entire quality of the finished product does not solely depend on the materials, the quality and finish of the product may vary according to design standards and complexity of the design there will be no refund if you are not satisfied with the quality. 

We will not supply any product that does not meet our quality assurance checks at the time of manufacture. 

Our products are of a sufficient quality that they will be reasonably durable and fit for purpose when used as intended.

Although every effort has been made to verify the accuracy of the information contained in this web site, Memento Memory Makers its officers, employees and agents disclaim all liability (except for any liability which by law cannot be excluded), for any error, inaccuracy in, or omission from the information contained on this website or via emails or any loss or damage suffered by any person or business directly or indirectly through relying on this information.

Any advice or suggestions offered are considering general usage and application, if still unsure please take professional advice before making your decision.

You must acknowledge the limitations of 3D printing technology before making final decision on any product or services agreement.

We endeavour to give accurate dimensions for our items.  We measure our items using digital callipers.  The tolerance of these is +-0.01mm.  To allow for slight changes that occur during production from one item to the next, we allow for a +-2mm tolerance.  Where there has been a customisation added to an item (such as a name – custom gyro rings), this is not reflected in the dimensions listed on this website.

We endeavour to give accurate print times for our items.  When we program the 3D printer, it gives us an estimation of the time the printing task will take.  It is this time estimate that we publish on our website.  We allow for a +-5min tolerance when listing a time frame.  

These estimates listed on this website do not include any customisations that were added to an item (such as a name) and as such are not reflected in the print times listed on this website.

4. PRICES, TAXES  AND PAYMENT

All prices are per unit (except where a bundle is indicated) and are in Australian Dollars (AUD). All prices are subject to change without notice.  Currently all items are GST free.  Memento Memory Makers is not required to notify customers if this GST Free Status changes.  Invoices will indicate the current GST Status.

5. CANCELLATION OF ORDERS BY US

There are technical or other reasons why Memento Memory Makers may not accept or may cancel your order during the entire ordering process, even after our acceptance of your order. 

Such reasons can be but are not limited to, maintenance or breakdown of a 3D printer. In the case we cancel your partial or entire order, we will contact you via email and, except in cases of fraud or other violations of our policies, issue you a full refund for the cancelled item(s).

6. DELIVERY

Memento Memory Makers will see to it that reasonable means will be exhausted to meet the shipment dates quoted, although we will not be liable for any special, incidental, or consequential damages resulting from delivery delays or inability to deliver. 

Prices quoted do not include customs duties, GST, freight or insurance. If the buyer chooses to contract their own freight carrier, title and risk of loss shall pass to the buyer upon pick-up of the freight carrier. 

In the absence of specific written instruction from the buyer, Memento Memory Makers will select the Australia Post as the carrier. Buyer shall be responsible for any freight charge and any insurance charge.

7. DAMAGED GOODS

In the event products are received damaged, please refer to our Refund and Return Policy 

8. LIMITATION OF LIABILITY

Memento Memory Makers will not be liable for any loss of profits, loss of income, loss of contracts, loss of data, damage, compensation for moral harm, costs, losses, lost turnover, or liabilities of any nature which may arise from the use of the website, its contents or manufactured products. 

Whether foreseen or unforeseen. 

Memento Memory Makers liability shall be limited to the total amount paid by the customer for their order.

9. ENTIRE AGREEMENT

The entire contract is embodied in this writing. There are no understandings, agreements, representations, or warranties, either oral or written, relative to the products, including statements made in or conduct implied from past dealings that are not fully expressed herein. 

No oral or any other form of statement after the acceptance of the purchase order purporting to modify the said terms and conditions shall be binding unless consented to in writing by a duly authorised officer of Memento Memory Makers in a document making specific reference to this transaction or after a transaction has been made.
